First Degree Vehicular Homicide Case Ends with Misdemeanor Probation
In a recent case, the client had been charged with DUI and First Degree Vehicular Homicide. VH1, as Georgia lawyers refer to it, carries up to 15 years in prison, and it is not unusual to see sentences of eight years or more of incarceration. After extensive review of the evidence and negotiation, the case was closed with a plea of guilty to second degree vehicular homicide (VH2), a misdemeanor and a plea of nolo contendere (no contest) to Driving While License Suspended. The client received 24 months of probation with fines and surcharges to be paid while on probation. VH2 carries a short suspension period but is eligible for a limited permit during that period. It was a very appropriate resolution of the case where two reporting officers opined that the defendant would not have been to see the victim where he had lain down in the middle of the road.
